Our TFDP Photography Terms...

General Terms

1. The TFDP Photography Session will be for a maximum of 2 hours and booked by prior arrangement and agreement
2. The Model will be responsible for Hair and Makeup and providing clothing/costumes, facilities are available at the studio for changing and makeup.
3. The resulting images will be made available to the Model by electronic download following Post Production of the images, there is no time line made available for the image production, but it is expected that this will take between 2 weeks minimum and 5 weeks maximum depending the Studio's workload. Electronic internet download is the only way that the Images are made available to the Model.
4. At all times the copyright remains with VisualChaos Studios (the "Photographer") and is never passed to the Model.
5. The Images are made available to the Model under a non-exclusive License (see below) and subject to these Terms of use.
6. The Images will remain available for download for up to two weeks after which they may be removed.
7. The Model should make sufficient backups of the Images as there will be no obligation upon the Photographer to keep and store the Images following this time period.
8. The 1988 Copyright Act assigns the copyright to the VisualChaos Studios photographer. All digital image files remain the intellectual property of the photographer.
9. VisualChaos Studios reserves the right to use the proofs, prints, images and digital image files for display at the studio, in publicity and marketing material and in websites online, including our Facebook pages, for promotional, re-sale, competition entry and any other purpose without liability or compensation to the Model. The acceptance of these Terms amounts to a “Model Release” for the use of the images. Although a separate Model Release will by required at the Session.
10. They may be circumstances that necessitate The Photographer to amend or cancel the Photography Session. All efforts will be made to communicate this to the Model in good time using the contact information provided and for a rescheduled appointment to be made.
11. The Images presented for download are the final images, there will be no other images available or no further work carried out. Further re-touching or digital manipulation may be available at the Model's cost, subject to the photographer's current rates of charge.
12. The Images will be made available for download sized no bigger than 12 inches (A4 ish) on the longest size at 300 dpi in JPEG format. No other sizes or formats will be made available.

Image License

The images (the "Images") either singularly or as a collection shot or created by Steve and/or Sarah Fisher of VisualChaos Studios (the "Licensor") and numbered between 20000-001 to 29999-9999 or within this number range are made available to the Model (the "Licensee") by electronic download subject to the Terms and License contained herewith. These Images are encoded with the Licensor's copyright (c) VisualChaos Studios, changing the Images identification and metadata will be deemed as a breach of this License, and as such, this License will be automatically terminated.

The Licensee may use the Images for personal and professional/portfolio use but only in connection with the Models self-promotion as a model for hire.

RESTRICTIONS ON USE Except as provided herein, the Licensee may not:
i. sublicense, sell, assign, convey or transfer any of its rights under this License;
ii. sell, retail, and distribute or in any way seek payment or profit either personally or through others or agents;
iii. communicate, suggest, represent or imply that the Licensee or any other party other than the Licensor has the Copyright to the Images or any part of the Images, whether the Images be presented in their original form or following any re-design, cropping, digital manipulation of any kind;
iv. incorporate the Images into a logo, trademark or service mark;
v. distribute, post or upload the Image(s) online in a downloadable format or to any stock image library;
vi. use any Image in a pornographic, defamatory, libellous or otherwise illegal manner, whether directly or in context or juxtaposition with other images or materials;
vii. any local, national or inter-national TV, newspaper, magazine, notice board or billboard advertising campaign other than for self promotion
viii. pass, transfer, copy or make available the Images to any other person other than the Licensee's or the Licensee's agent or representative
